Welcome to FundraiseUs. By creating a campaign or using our platform, you agree to be bound by these Terms of Service. Please read them carefully, as they govern your legal rights and responsibilities regarding campaigns, fees, merchandise, and liabilities.

1. Acceptable Use and Prohibited Campaigns

FundraiseUs is designed to help communities, schools, and organizations raise money. However, we strictly prohibit the use of our platform for certain types of fundraising. You may not create a campaign that:

  • Funds or promotes political campaigns, PACs, or lobbying efforts.
  • Funds, promotes, or involves any illegal activity, illicit goods, or services.
  • Violates the terms of our payment processor, Stripe.

We reserve the right to immediately suspend or terminate any campaign that violates these rules.

2. Fees, Taxes, and Chargebacks

Fees: We charge a 10% platform fee exclusively on merchandise sold through the platform. Flat donations incur a 0% platform fee. All transactions are subject to standard payment processing fees (2.9% + $0.30 per transaction) assessed by Stripe.

Taxes: While the FundraiseUs checkout system calculates estimated sales tax based on the supporter's state, the Campaign Organizer is solely responsible for all tax compliance. You are responsible for registering, collecting, reporting, and remitting any applicable sales, use, or income taxes to the appropriate government authorities.

Chargebacks & Fraud: If a supporter disputes a credit card charge (a "chargeback"), the disputed amount, along with any associated bank penalty fees, will be deducted directly from the Campaign Organizer's account balance.

3. Merchandise and Fulfillment Disputes

Organizers have the option to sell items from our automated catalog or list their own custom merchandise.

  • Catalog Items: FundraiseUs facilitates the printing and shipping of these items through our fulfillment network.
  • Custom Organizer Items: For any custom items not sourced from our catalog, the Organizer is entirely responsible for storage, packaging, and shipping directly to the supporter.

If a supporter files a complaint regarding unfulfilled custom merchandise, FundraiseUs reserves the right to refund the supporter directly from the Organizer's account balance. Repeated fulfillment failures will result in campaign suspension.

4. Intellectual Property and Copyright

By uploading logos, designs, or artwork to FundraiseUs, you warrant that you hold the legal right or appropriate licensing to use and distribute those assets. We generally enforce a "Three-Strikes" policy for copyright infringement, wherein repeated violations will result in permanent account termination. However, we explicitly reserve the right to immediately terminate any campaign at our sole discretion if a severe intellectual property violation occurs.

5. Limitation of Liability

FundraiseUs provides the platform "as is." We are not liable for any lost profits, lost data, delayed payouts due to bank errors, or fulfillment delays caused by third-party shipping carriers or dropshipping suppliers. In no event shall our total liability to you exceed the total platform fees collected from your specific campaign.
